Introduction

1.1 The sale of 4308 products via the 4308.STORE website (hereinafter referred to as the “Website”, the seller – “FOP Zhyvachuk Ivanna Vasylivna, IPN 3670311987”) is governed by these General Terms and Conditions. Please read these General Terms and Conditions carefully before placing an order with 4308.STORE. These General Terms and Conditions cover the delivery of products from 4308.STORE, changes to the contract, possible ways to resolve problems, etc. If you believe that there is an error in these General Terms and Conditions, please contact 4308.STORE for further discussion.

1.2 The purchase of products via this website is governed by these General Terms and Conditions, which are exclusively reserved for the consumer (hereinafter referred to as “You”). You may purchase products on this website only if you are 18 years of age or older (or, if younger, have a legal representative).

1.3 Products can be delivered to most countries worldwide as specified in the order form (delivery).

1.4 The purchase of Products is governed solely by the General Terms and Conditions published on the website.

1.5 4308.STORE reserves the right to make changes to the General Terms and Conditions at any time without notice. However, any changes will only be valid for purchases made after the date of publication of the new version of the General Terms and Conditions online.

If the General Terms and Conditions are replaced by a new version, the previous version of the General Terms and Conditions shall no longer be applicable, valid or enforceable in relation to any purchases made after such previous version has been removed from the Website.

1.6 4308.STORE reserves the right to refuse to sell the Products if we have reason to believe that the purpose of the purchase is to copy the 4308.STORE design or that the Products will be used in an unlawful manner.

Making a purchase

2.1 Each Product offered for sale on the Website can be viewed by clicking on a specific link displaying a product photo, unit price, colors, sizes.

2.2 The Products you have selected must be placed in a specific section (hereinafter referred to as the “Shopping Cart”). The Shopping Cart must contain: a description of the Products, including details of the dimensions and one or more photos that clearly show the Products.

2.3 The digital photographs of the Products provided on the Website and in the shopping cart are for illustrative purposes only. Although 4308.STORE has made every effort to accurately display the colors, it cannot be guaranteed that the display of the colors of the device accurately reflects the color of the products. Your products may differ slightly from these images.

2.4 To view the selected products and the total cost of the order, visit the shopping cart. The purchase process allows you to check and correct any errors before confirming the order with 4308.STORE. Please read and check your order carefully at each stage of the purchase. Before confirming the relevant order (hereinafter referred to as the “Order”), be careful to check the correctness of the contents of the shopping cart and complete the order form in accordance with the instructions provided on the Website.

2.5 The purchase process is completed as soon as you click on the last order confirmation button “Buy” (hereinafter referred to as the “Buy Button”). Your Order is also checked by 4308.STORE.

2.6 As a general rule, after clicking the Buy Button, the content of the order cannot be changed by you. However, upon receiving your written request to change the order after clicking the Buy Button, we will try to help resolve this issue if the order has not yet been shipped. 4308.STORE does not guarantee that the order will be changed or canceled after clicking the Buy Button.

2.7 Before confirming the order, you must confirm that you have read and accepted these General Terms and Conditions. After completing the purchase process, you must save or print the General Terms and Conditions.

2.8 The purchase process set out in point 3 must be completed in full. Failure to comply with this obligation means that the order cannot be submitted to 4308.STORE.

2.9 4308.STORE will use the personal information you provide: (i) to deliver the products; (ii) to process your payment; and (iii) to provide you with information about similar products if you have agreed to this during the ordering process. You may opt out of receiving this information at any time by contacting 4308.STORE. 4308.STORE will only share your personal information with third parties if the law either requires or permits 4308.STORE to do so.

2.10 You acknowledge that you are responsible for the accuracy and truthfulness of any data entered on the Website or otherwise used at the time of making a purchase.

2.11 You are aware that on the Website you may have the opportunity to order products prior to their commercial launch or distribution and placement on the market (“Pre-Ordered Products”). You acknowledge that such pre-ordered products are not yet available for general sale. Pre-ordered products are clearly identified and marked on the Website by the wording “Order” or “Pre-Ordered Product”. The Pre-ordered Product will be delivered to you on or before the estimated date specified in the description of the product page on the Website at the time of placing your order.

2.12 You acknowledge and agree that if you order a Pre-Ordered Product, the relevant price shown on the Website and displayed in the Cart section will be charged after you have clicked the Buy Button.

2.13 Any further details relating to payment, delivery and confirmation of pre-ordered products are set out below in the relevant sections.

2.14 You acknowledge and agree that, except as specifically provided herein for Pre-Ordered Products, the other provisions of these Terms and Conditions will apply to Pre-Ordered Products.

Contract Execution

3.1 After you have confirmed your order and clicked the Buy Button, the Order is submitted to 4308.STORE for processing and cannot be further modified or canceled. The Order placed by you is only processed by 4308.STORE if the entire purchase process has been properly carried out and the website does not report any errors. After placing the order, you will receive an automatic email from 4308.STORE confirming that your order has been accepted. However, please note that during the process of preparing the product for delivery due to some unexpected events (e.g. the only available Product is damaged/defective) 4308.STORE may not fulfill your order. In such a case, 4308.STORE will immediately send you an email with an offer to modify or cancel the order, and in case of cancellation, to refund you the full order value.

Price and payment method

4.1 The relevant prices are displayed in UAH (UAH).

4.2 The prices displayed on the Website and in the Cart will be charged to you once you confirm your order by clicking the Buy Button.

4.3 4308.STORE only accepts those payment methods that are clearly indicated on the Website.

4.4 In order to make a payment, you confirm and guarantee that you are the owner of the account used for the purchase.

4.5 The Products purchased shall only be shipped after payment of the full amount. In the event that for any reason you cannot be charged, the sale process will be automatically terminated and the sale will be canceled, and you will be notified accordingly.

4.6 In the event of the unavailability of one or more Products, and if you decide not to cancel the Order in its entirety, the difference between the amount charged and the value of the available Products, as well as any associated shipping costs, will be refunded to you.

Delivery

5.1 4308.STORE uses the services of Nova Poshta for all deliveries within Ukraine. Outside Ukraine, delivery is carried out by Ukrposhta.

5.2 For security reasons, 4308.STORE cannot process any order to a post office address or accept any order that does not allow the identification of the natural person who is considered the recipient of the order and the corresponding address.

5.3 Products are considered delivered after 4308.STORE hands them over to the delivery courier. 4308.STORE delivers the Products to the courier within 3 (three) business days from the date of payment for the Product. 4308.STORE is not responsible for loss or damage to the Products by the courier.

5.4 4308.STORE customer support provides the necessary assistance in resolving any potential problem related to delivery. You can contact 4308.STORE customer service by email at SALES@4308.STORE.

Product conformity

6.1 Once you have received the receipt from the courier, you must check the Products to ensure that they correspond to the products ordered and that there are no manufacturing defects or non-conformities.

6.2 In the event that the Product delivered has a manufacturing defect or is not the size you ordered, you have the right to return or replace the Product free of charge (if available). In the event of a Product return, the price charged will be refunded to you in full. It is understood that you will lose this right if you do not notify 4308.STORE of the lack of conformity of the Product within 14 (fourteen) days from the date of delivery.

6.3 Products purchased with discounts cannot be returned or replaced unless they have a manufacturing defect.

Limitation of liability

7.1 4308.STORE shall not be liable for any loss or damage suffered by you as a result of 4308.STORE’s failure to comply with these Terms and Conditions unless such failure is caused by 4308.STORE’s fault or negligence.

7.2 4308.STORE supplies the Products for your private use only. If you use the Products for resale or for any other commercial purpose, 4308.STORE shall not be liable to you for any loss of profits, loss of business, business interruption or loss of business opportunity.

7.3 4308.STORE does not exclude or limit in any way our liability to you. This includes liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) violation of your legal rights in relation to the Products, including the right to receive the products as described and the relevant information provided to you through 4308.STORE; and (iii) defective products.

7.4 4308.STORE shall not be liable in the event of your refusal to clear customs and pay import taxes, VAT (if applicable) and other import charges as required by applicable law. 4308.STORE shall not be liable in the event that the Products cannot be delivered to you by the courier carrier due to a ban in your country or any other restrictions on the import of such Products. In the cases listed in clause 7.4 of the General Terms and Conditions, the product price and delivery costs are not refundable.

7.5 Subject to clause 7, and to the extent permitted by law, 4308.STORE's total liability to you for damages arising in connection with the Terms and Conditions, contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no event exceed the total price of the Products ordered.

Product authenticity and intellectual property rights

8.1 4308.STORE guarantees the authenticity and high quality of all products offered for sale on the website.

8.2 The 4308.STORE trademark, as well as all figurative and non-figurative signs and, in general, all other trademarks, illustrations, images and logos found on 4308.STORE products, related accessories and/or packaging, whether registered or not, are and will remain the exclusive property of 4308.STORE. The reproduction, in whole or in part, modification or use of these trademarks, illustrations, images and logos for any reason and with any support is strictly prohibited.
